ОБЩА ИНФОРМАЦИЯ

Съкращаването е форма на уволнение от вашата работа. Това се случва, когато работодателите трябва да намалят работната ръка.

Ако бъдете съкратени, може да имате право на неща като:

  • обезщетение за съкращение
  • период на предизвестие
  • консултация с вашия работодател
  • възможност да се преместите на друга работа
  • отпуск за намиране на нова работа

Трябва да сте съкратени по обективни и справедливи причини, например поради нивото на вашия опит или способност да вършите работата.

Не можете да бъдете съкратени заради вашата възраст, пол или поради инвалидност или бременност. Ако това се случи, съкращението може да бъде квалифицирано като несправедливо.

КОЙ ДА БЪДЕ СЪКРАТЕН

Вашият работодател трябва да бъде справедлив и обективен при взимането на решение кой да бъде съкратен.

Обикновено използваните методи са:

  • последно постъпилите да си тръгват първи (най-напред са избирани служители с най-кратък трудов стаж)
  • доброволно съкращение (човек сам се предлага за съкращение)
  • съкращение заради дисциплинарни нарушения
  • оценки на персонала, умения, квалификация и опит

Работодателят ви може да ви съкрати, без да се налага да следва процедурата за подбор, ако вашата работна позиция вече не съществува, например ако:

  • работодателят закрие цял отдел, което прави всички служители, работещи в него, излишни
  • вие сте единственият служител във вашия отдел

Вашият работодател може да ви предложи различна роля, ако има такава възможност.

Ако вашият работодател съкращава последно постъпилите на работа служители, уверете се, че не става въпрос за дискриминация, например ако само младите хора биват съкратени.

Повторно кандидатстване за същата позиция

Може да бъдете помолени да кандидатствате отново за вашата работна позиция, което би помогнало на вашия работодател да реши кой да избере.

Несправедлив избор

Ако бъдете съкратени от работа поради някоя от изброените по-долу причини, вашето съкращение ще бъде квалифицирано като несправедливо:

  • пол
  • семейно положение
  • сексуална ориентация
  • раса
  • инвалидност
  • религия или вяра
  • възраст
  • вашето членство или липсата на членство в синдикат
  • дейностиза здраве и безопасност
  • работен модел, например служители на непълно работно време или срочни трудови договори
  • отпуск по майчинство, раждане или бременност
  • отпуск по бащинство, отпуск за отглеждане на дете или лишаване от свобода
  • ако упражнявате законните си права
  • като например да съобщите за нарушения от страна на вашия работодател
  • заради участие в законосъобразни стачни действия с продължителност 12 седмици или по-малко
  • заради предприемане на действия по отношение на здравето и безопасността
  • ако сте призовани да бъдете съдебни заседатели
  • ако сте довереникът на фирмената пенсионна схема

Ако не сте съгласни с решението

Можете да обжалвате, ако смятате, че сте били несправедливо съкратени. Пишете на работодателя си и обяснете причините.

Възможно е да се обърнете към трудов съд в случай на несправедливо уволнение.

Доброволно напускане

Ако искате да бъдете съкратени доброволно, решението за това зависи от вашият работодател.

Вашият работодател не може просто да предложи доброволно уволнение на хора от определени възрастови групи, които имат право на пакет за ранно пенсиониране – това би могло да бъде незаконна възрастова дискриминация.

Въпреки това, пакетът за ранно пенсиониране (за определени възрастови групи) може да бъде един от елементите на доброволното предложение за съкращение.

Обучаващи се работници / стажанти

Говорете с вашия мениджър и доставчик на обучение, ако сте стажант и се притеснявате, че можете да бъдете съкратени.

Вашият доставчик на обучение или Националната служба за чиракуване може да ви съдействат в намирането на друг работодател, който да ви помогне да завършите стажа си.

Програмите за стажуване са различни в Шотландия, Уелс и Северна Ирландия.

ИЗПЛАЩАНЕ НА ОБЕЗЩЕТЕНИЯ ПРИ СЪКРАЩЕНИЕ

Обикновено ще имате право на задължително заплащане при съкращения, ако сте нает (employee) и сте работили за настоящия си работодател 2 или повече години.

Ще получите:

  • заплащането за половин седмица за всяка пълна година, през която сте работили за работодателя, като обезщетение, ако сте били под 22 години
  • заплащането за една седмица за всяка година, през която сте работили за работодателя, като обезщетение, ако сте на възраст между 22 и 40 години
  • заплащането за седмица и половина за всяка година, през която сте служили на работодателя, като обезщетение, ако сте над 41 години

Ако сте били съкратени на или след 6 април 2017 г., вашето седмично заплащане е ограничено до £489, а максималната законоустановена заплата, която можете да получите, е £14,670. Ако сте били съкратени преди 6 април 2017 г., тези суми ще бъдат по-ниски.

Изчислете колко може да получите при съкращение

Изплащането на съкращения (включително всяко обезщетение при прекратяване на трудов договор) под 30 000 GBP не е облагаемо.

Вашият работодател ще приспадне данъчните и националните осигурителни вноски от всички заплати или отпуски, които ви дължи.

Изключения

Нямате право на законно възнаграждения при съкращение, ако:

  • вашият работодател предложи да ви задържи на работа
  • вашият работодател ви предлага подходяща алтернативна работа, която отказвате без основателна причина

Уволнението от работа поради неправомерно поведение не се счита за съкращение, така че в тези случаи няма да получите обезщетение за съкращение.

Нямате право на законно заплащане при съкращение, ако попадате в една или повече от следните категории:

  • бивши регистрирани работници на док (обхванати от други договорености) и рибари
  • служители на короната, членове на въоръжените сили или полицейски служби
  • чираци, които не са работили като наети в края на обучението си
  • домана помощничка/помощник, пряк член на семейството на работодателя

Краткосрочни и временни съкращения

Можете да поискате законоустановени плащания при съкращение, ако отговаряте на условията и сте временно съкратени (без заплащане или със заплащане в размер на по-малко от половин седмична заплата) за:

  • повече от 4 последователни седмици
  • повече от 6 последователни седмици в период от 13 седмици

Известете вашия работодател, че възнамерявате да кандидатствате за законно заплащане. Това трябва да се направи в рамките на 4 седмици от последния неработен ден в периода от 4 до 6 седмици.

Ако вашият работодател не отхвърли искането ви в рамките на 7 дни от получаването му, пишете на работодателя отново, като му съобщите това.

Твърдението ви може да бъде отхвърлено, ако е вероятно да започнете работа отново в рамките на 4 седмици и да продължите да работите най-малко 13 седмици.

ПОЛУЧАВАНЕ НА ПРЕДИЗВЕСТИЕ

Трябва да ви бъде дадено предизвестие преди приключване на трудовите ви взаимоотношения.

Задължителните периоди за получаване на предизвестия за съкращение са:

  • най-малко една седмица предизвестие, ако работите във фирмата от един месец до две години
  • едноседмично предизвестие за всяка година, ако работите между 2 и 12 години
  • 12-седмично предизвестие, ако работите от 12 или повече години

Проверете договора си. Работодателят ви може да ви даде предизвестие и по-рано от законоустановения минимум, но не и по-късно.

Заплащане при получаване на предизвестие

Освен плащанията за обезщетение при съкращение, вашият работодател трябва:

  • да ви плати за периода от получаване на предизвестието
  • да ви плати компенсация при липса на предизвестие в зависимост от обстоятелствата

Заплащане при липса на предизвестие

Работата ви може да бъде прекратена без предупреждение, ако в договора е включено “заплащане вместо предупреждение”. Вашият работодател ще ви плати, вместо да ви дава период на предизвестие.

Получавате цялата основна заплата, която бихте получили по време на периода на предизвестие. Може да получите допълнителни суми като пенсионни вноски или частно здравно осигуряване, ако това е включено в договора ви.

Вашият работодател може да ви предложи заплащане вместо предизвестие, дори ако договорът ви не го споменава. Ако приемете, трябва да получите пълно заплащане и всякакви допълнителни плащания, споменати в договора Ви.

КОНСУЛТАЦИЯ

Имате право да се консултирате с работодателя си, ако бъдете съкратени. Това включва провеждането на разговор относно:

  • защо сте избрани да бъдете съкратени
  • всички алтернативи на съкращението

Можете да подадете иск пред трудов съд, ако работодателят ви не проведе консултацията по правилния начин, например ако започне със закъснение или консултацията не се осъществи изобщо.

Колективни съкращения

Ако вашият работодател съкращава едновременно 20 или повече служители, консултацията трябва да се извърши между вашия работодател и представител, който може да е:

  • профсъюзен представител (ако сте представлявани от синдикат)
  • избран за целта служител (ако не сте представлявани от синдикат или ако вашият работодател не признава вашия синдикат)

Колективните консултации трябва да обхващат теми като:

  • начини за избягване на съкращенията
  • причините за съкращенията
  • как да се сведе до минимум броя на уволненията
  • как да се ограничат негативните ефектите за дадените служители, например чрез предлагане на преквалификация

Вашият работодател също така трябва да отговаря на определени правни изисквания за провеждане на колективни консултации.

Продължителност на консултациите

Няма ограничение във времето за продължителността на консултацията, но минималният срок е:

  • 20 до 99 съкращения – консултацията трябва да започне най-малко 30 дни преди да влязат в сила всички съкращение
  • 100 или повече съкращения – консултацията трябва да започне най-малко 45 дни преди началото на всяко съкращение

Избиране на представител сред служителите, които ще бъдат съкратени

Ако сте служител, засегнат от предложените съкращения, можете да:

  • да се кандидатирате за представител на служителите, предложени за съкращение
  • гласувате за избирането да друг представител

Служители на срочни договори

Не е необходимо вашият работодател да ви включва в колективните консултации, ако сте наети на работа при срочен трудов договор, освен ако прекрати договора ви рано поради съкращения.

ПОДХОДЯЩА АЛТЕРНАТИВНА РАБОТА

Работодателят ви може да ви предложи “подходяща алтернативна работа” във вашата организация или фирма.

Дали работата е подходяща за вас зависи от:

  • това колко общо има тя с настоящата ви работна позиция
  • условията на предлаганата работа
  • вашите умения и способности, и обстоятелствата свързани с работата
  • вашето заплащането (включително обезщетения), статус, работни часове и местоположение

Вашето съкращение може да бъде класифицирано като несправедливо, ако работодателят ви има подходяща алтернативна позиция за вас и не ви я предложи.

Отхвърляне на оферта

Може да загубите правото си на законно възнаграждение при съкращение, ако необосновано отхвърлите подходяща алтернативна позиция.

Можете да се обърнете към трудов съд, ако смятате, че предложената ви работа не е подходяща.

Пробни периоди

Имате право на 4 седмичен пробен период за всяка алтернативна позиция, която ви предложат.

Периодът от 4 седмици може да бъде удължен, ако се нуждаете от обучение. Всяко удължаване трябва да бъде договорено в писмена форма преди началото на пробния период.

Ако по време на пробния период решите, че новата работа не е подходяща за вас, кажете го на работодателя си. Това няма да засегне вашите трудови права, включително правото ви на законоустановени плащания при съкращения.

Ще загубите правото си да поискате законоустановени плащания при съкращения, ако не подадете известие в рамките на 4-седмичния пробен период.

Време за намиране на работа

Ако сте работили непрекъснато в продължение на 2 години до датата, на която изтече срокът ви на предизвестие, имате право на разумен период от време, за да:

  • потърсите друга работа
  • започнете обучение, което да ви помогне в намирането на друга работа

Колко време може да ви отнеме това, зависи от вашите обстоятелства.

Независимо от това колко време ще отделите, за да потърсите друга работа, най-голямата възможна сума, което вашият работодател трябва да ви плати е 40% от заплащането за една седмица.

Пример:

Ако работите 5 дни в седмицата и си вземете общо 4 дни отпуск за целия период на предизвестие – вашият работодател трябва да ви плати само за първите 2 дни.

ПОМОЩ В НАМИРАНЕТО НА НОВА РАБОТА

Свържете се с местния Jobcentre  и попитайте за услугата за бързо реагиране (Rapid Response Service):

  • ако подозирате, че ще бъдете съкратени
  • по време на предизвестието
  • до 13 седмици след като сте били съкратени

Те също така могат да платят за неща като професионално обучение, ако не разполагате с друго финансиране и да ви помогнат бързо да се върнете на работа. Най-напред трябва вашият период на предизвестие да е започнал.
