Според закона, работодателят ви трябва да има установена процедура за дисциплинарно уволнение, за която вие трябва да сте информирани. До два месеца от започване на работа, трябва да получите информация относно работата ви, заплащането и работните часове, която да е в писмен вид. В изявлението трябва да е описана и процедурата по дисциплинарно уволнение, или ако не е вписана там, да е обявено в кой документ може да се прочете за нея.
Ако работодателят ви иска да ви уволни или да предприеме други дисциплинарни действия, по закон, той трябва да се съобрази с стандартната законно установена процедура при дисциплинарно уволнение. Тя се състои от три стъпки. Ако вашият работодател спазва по-различна процедура, тя може да е от повече стъпки и вие задължително трябва да сте запознати с нея. При условие, че се спазва различна процедура от стандартната, работодателят е длъжен да следва нея и всяка една нейна стъпка.
Стандартната процедура се състои от следните стъпки:
- Писмено изявление – това е първата стъпка, която работодателят ви трябва да предприеме, ако иска да ви уволни дисциплинарно. В писменото си изявление, той трябва да опише конкретно отправеното към вас оплакване. Ако мислите, че липсва информация, трябва да съобщите това на работодателя си, за да може да я предостави преди изслушването. Обикновено от работодателя се очаква да ви предостави и доказателства за провинението ви, за да може да обмислите информацията.
- Среща – след като е изпратено писменото изявление, работодателят трябва да ви насрочи среща, за да обсъдите нещата. Трябва да ви е предоставено достатъчно време преди срещата, за да може да обмислите проблема, но от вас се очаква да не отлагате срещата поради неоснователни причини. Преди срещата, работодателят няма право да предприема дисциплинарни действия. На срещата вие имате право да си вземете и придружител, някой колега или представител от професионалния съюз. Срещата трябва да е насрочена на удобна за вас (и вашият придружител) дата и час и вие нямате право да не се явите. Подгответе се добре за срещата. След като се явите, работодателят ще обясни по какъв ред ще говорите, след което ще представи обвиненията и доказателствата към тях. Изслушайте обвиненията, след което разкажете от ваша гледна точка как стоят нещата. Вие имате думата и тя трябва да ви бъде дадена в един момент, така, че не се притеснявайте. Ако искате може да си водите и записки. След като приключи срещата, работодателят ви трябва да ви съобщи какво е крайното му решение и какви мерки ще бъдат предприети. Ако не сте съгласни с това, имате право да обжалвате, но това трябва да стане преди да се обърнете към служебния трибунал, или компенсацията ви ще бъде намалена.
- Апелационна среща – при условие, че сте решили да обжалвате, трябва да информирате работодателя си за това в писмен вид. Запазете копие, в случай, че случаят ви стигне до служебния трибунал. Трябва да се насрочи допълнителна среща с работодателя ви, за да се обсъди вашата жалба. Условията по насрочването, придружаването, последствията от неявяване и протичането на срещата са същите като при първата ви среща. След срещата работодателят ви отново трябва да вземе решение и да ви информира за него. Това е крайно решение и ако вие отново не сте доволни от него може да отнесете случая до служебния трибунал.
Ако работодателят ви не е последвал с точност някоя от процедурите, трибуналът може да реши, че сте несправедливо уволнени.
При предупреждение преди предприемане на дисциплинарни действия, работодателят ви не е длъжен да спазва трите стъпки на стандартната процедура, тъй като това е само предупреждение. Ако след това обаче реши да ви уволни дисциплинарно, да ви удържи от заплатата или да ви понижи в длъжност, тогава вече трябва да ги спази.
Ако бъдете временно отстранени от длъжност на пълно заплащане, работодателят ви може да не спазва тази процедура, но ако ви намали заплащането, тя трябва да бъде спазена.
